Booking and Mediation Terms of Outdoor Adventure CC
1. Booking Procedure and Contract Conclusion
When you have selected and agreed to undertake a safari with Kuzikus or if you are satisfied with any tailor-made program, draft itinerary, and price, you confirm this by booking via email for yourself and your group. The person making the booking warrants that he or she has authority to enter into a contract on behalf of the other persons included. The person making the booking assumes personal liability for the total price of all bookings made by him/her. The contract is concluded upon written confirmation and invoice by the Operator, sent either directly to you or your travel agent.
Important Status Notice: The company Outdoor Adventure CC (owners Alina & Dieter Reisenauer) acts solely as a booking and mediation agent for all arrangements, activities, and stays at the Kuzikus Wildlife Reserve. The contractual partner for the stay and all services on-site is exclusively the local operator, the Reinhard Family (hereinafter referred to as the "Operator").
2. Payment Terms
Your booking is confirmed and accepted once a 15% deposit of the total safari value is received within 10 days of the confirmation date. Final payment is due to the designated Kuzikus account no later than 40 days prior to departure. For short-term bookings (less than 40 days prior to arrival), the full amount is payable immediately upon booking. Upon receipt of full payment, detailed tour information and vouchers will be sent to you. All safari services contractually start and end at the Kuzikus Wildlife Reserve. Guests with outstanding balances will not be permitted to participate.
3. Cancellation by the Customer
Cancellation of your booking must be made in writing and is only effective upon receipt by the Operator (or the mediation agent Outdoor Adventure CC for forwarding).
The scale of cancellation charges is as follows:
More than 40 days prior to arrival: Deposit is forfeited (15%).
39 days or less prior to arrival, as well as No-Shows: 100% of the total price.
The customer reserves the right to prove that the Operator suffered no damage or significantly less damage than the levied fee.
Should you fail to start the safari, join it after the starting date, or leave it prior to its completion, no refund can be made for unused services.
4. Booking Changes (Alternative Persons)
Should you wish to transfer your booking to an alternative person after confirmation, you may do so subject to availability and suitability of the participant. A handling fee of EUR 80.– per person will be charged.
5. Alterations and Higher Majeure
The Operator reserves the right at any time to make minor alterations to routes, accommodation, or program details if local conditions (such as seasonal rainfall on airfields or natural disasters like veldt fires) compel such measures.
In the event of the safari being rendered impossible, restricted, or inadvisable due to extraordinary circumstances beyond control (such as severe weather, bushfires, strikes, war, epidemics, or government restrictions), both the Operator and the customer have the right to cancel the contract. If cancelled prior to arrival, the customer will receive a refund of payments made. If these circumstances arise after the start of the safari, the Operator is entitled to compensation for services already rendered, including non-refundable expenses paid to local third-party providers. Extra expenses incurred as a result of such disruptions shall be the responsibility of the passenger.
6. Liability, Wild Animals and Local Risks
The Operator is liable for the proper execution of the services as described. However, please be aware that safaris take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur.
Neither the Operator nor the Mediation Agent, nor their employees, shall be liable for any loss, damage, sickness, injury, or death arising from force majeure, unpredictable natural events, weather conditions, or the inherent and potentially dangerous risks of a safari in the African bush (including wilderness courses, tracking, or excursions on horseback), provided there is no intent or gross negligence on their part.
The Operator may, at its discretion and without liability or cost to itself, terminate a passenger's booking at any time in the event of illness or illegal, dangerous, or incompatible behavior of the passenger. In such circumstances, the passenger shall not be entitled to any refund.
7. Photography
The Operator reserves the right to make use of any photograph or film taken on the safari by our staff for general publicity purposes without payment or specific permission. No photographs of a compromising nature will be used.
8. Refunds
While the Operator uses its best efforts to ensure that all anticipated accommodation and excursions are available as planned, there shall be no claim for a refund either in whole or in part if any accommodation or excursion becomes unavailable due to local circumstances or if the passenger was unable to use that service.
9. Mandatory Insurance
Due to the remote location and the nature of activities in the wildlife reserve, every participant is contractually required to take out comprehensive international travel health insurance, including specific coverage for emergency medical evacuation, accidents, and repatriation, before starting a safari with Kuzikus. Travel cancellation, luggage (including cameras and binoculars), and liability insurance are highly recommended.
10. Subcontracted Services and Airlines
Please note that the Operator (or the booking & mediation agent Outdoor Adventure CC) subcontracts flying services to independent charter operations who are solely responsible for the flight execution. The Operator and the Mediation Agent cannot be held liable for any delays or schedule changes due to airlines or charter companies not running to schedule. In the event of program changes resulting from airline mistakes or flight delays, the Operator shall in no way be liable for additional costs arising from such changes.
11. Passports, Visas, and Health Regulations
The customer is personally responsible for compliance with all passport, visa, customs, currency, and health regulations (e.g., mandatory vaccinations). All disadvantages and costs arising from non-compliance shall be borne by the customer.
12. Prices
We will do our utmost to keep to the prices published. Should unexpected cost increases be forced on us by airlines, exchange rates, or new government taxes, the Operator reserves the right to surcharge up to a maximum of 10% of the tour fare, provided the booking was made more than 3 months prior to departure.
13. Services Not Included
Unless specified otherwise, transfers, airport taxes, personal laundry, insurance, alcoholic beverages, gratuities to tour guides and camp staff, optional meals, and personal items are not included in the safari price.
14. Miscellaneous Terms
Guests requiring special diets are advised to inform the reservation office well in advance of departure. Unless transfers to and from airports at Windhoek have been booked directly through Kuzikus, the Operator shall in no way be responsible for the guests' transportation. The payment of the deposit or any partial payment for a reservation construes consent to all provisions of these conditions.
15. Severability Clause
The invalidity of individual provisions of these terms shall not affect the validity of the remaining provisions.
16. Governing Law & Jurisdiction
This agreement is made subject to, shall be governed by, and construed according to the laws of the Republic of Namibia. The courts of Namibia shall have exclusive jurisdiction over any disputes arising hereunder.
