Responsibility. Neither the company nor any person acting for, through or on behalf of the company, shall be liable of any loss or damage whatsoever arising from any causes whatsoever and without restricting the generality thereof. The company shall not be responsible for loss or damage arising from any errors or omissions contained in its brochure or other literature, late or non-confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death and whether, occasioned by negligence or not. In addition the Company shall have the right at any time and at its discretion, to cancel the safari or the remainder thereof or make alterations in route, accommodation, price or other details. The same accounts in the event of the Safari being rendered impossible, illegal or inadvisable by weather,  strike, war, government or interference or any other cause whatsoever. The extra expenses incurred as a result thereof shall be the responsibility of the passengers. The Company may at its discretion and without liability or cost of itself, and at any time cancel or terminate the passengers booking. Without limiting the generality of the company, it shall be entitled to do so in the event of the illness or the illegal or incompatible behaviour of the passenger, who shall in such circumstances not be entitled to any refund.

Photography. The Company reserves the right without further notice to make use of any photograph or film  taken on the safari by our staff for general publicity purposes without payment or permission. We guarantee that no photographs of compromising nature will be used.

Wild animals. Please be aware that our safaris may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. Neither the company, nor their employees, nor agents can be held responsible for any injury or accident on the safari.

Weather. Please be aware that the Kalahari can be characterized by severe changes in weather conditions ranging from extreme cold to extreme hot, sand-storms and rain. Such extreme conditions are rare, but no safari into the African wilderness can guarantee that this will not occur. Neither the company, nor their employees, nor agents can be held responsible for any weather condition and no refunds shall be paid in the event of guests opting to leave early.

Changes to schedule. Although every effort is made to adhere to schedules/programs it should be borne in mind that the Company reserves the right, and in fact is obliged, to occasionally change programs as dictated by changing conditions. Such conditions may be brought about by seasonal rainfall on airfields or natural disasters such as veldt fires.

Refunds. While the Company uses its best efforts to ensure that all anticipated accommodation is available as planned, there shall be no claim of any nature against the Company for a refund either in the whole or part, if any accommodation or excursion is unavailable or the passenger was unable to use that service.

Insurance. You must take out comprehensive insurance cover before travel for cancellation, medical expenses, personal baggage and money with your travel agent before starting a safari with KUZIKUS. This should be arranged at the time of payment of the deposit to cover you. KUZIKUS as well as any other travel agent are only agents for the traveller and cannot be held responsible for any delay, accidents, illness, death, injury and losses. Therefore we recommend each travelling guest in our country to take out a special travel insurance for foreign countries to cover medical care for illness and accidents, medical care transport back to their home country, any other losses due to accidents, luggage (camera and binoculars) and cancellation costs.

Exemption from indemnity. Due to the direct contact with wild animals and the nature of wilderness courses, tracking or excursions on horseback Safaris are potentially dangerous. KUZIKUS do not accept any liability for any accidents, illness or death of a client of KUZIKUS or any damage during or after the stay in KUZIKUS, transfers from / to Windhoek or anywhere else or for any additional expenses, or for the negligence of any company or personal entrusted to the company.

The passengers tickets in use by the airline or by other carriers concerned when issued, shall constitute the sole contract between the airlines and the purchaser of these tickets and/or passengers. Please note that KUZIKUS subcontracts the flying services to independent charter operations who are responsible for the flying. In the event of changes of programs and schedules, resulting in any additional services rendered due to airline mistake, KUZIKUS shall be in no way liable for costs arising from such changes and delays.

Prices. We will do our utmost to keep to the prices published. Should increases be forced on us by airlines, exchange rates, new taxes etc. we reserve the right to surcharge without notice, up to a maximum of 15% of the fare.
